OFFICIAL CONTEST RULES AND REGULATIONS
NO PURCHASE NECESSARY
SECTION 1: HOW TO ENTER
1. Starting March 8th, 2010 at approximately 9:59 a.m. Eastern Time (ET), entrants can enter the Treehouse and Mattel "Thomas & Friends™ Take-n-Play™" Contest (the "Contest") on-line at www.treehousetv.com. Entrants must complete and submit the entire on-line Contest entry form (the "Entry Form") including the entrant's full name, postal code, age, email and telephone number to be eligible to win. A completed Entry Form will constitute one (1) entry into the Contest.
2. Each entrant is allowed to submit one (1) entry per day. Only one e-mail address and account may be used by any person to enter the Contest. If it is discovered in the ordinary course of running the Contest that an entrant has attempted to enter on more than one (1) occasion per day, that entrant may, at the discretion of the Treehouse TV, Mattel & HIT Entertainment (collectively known as the "Sponsors"), be disqualified from the Contest. Should it be discovered that an entrant is using the aid of computer programs to auto-fill entries, that entrant will be immediately disqualified from the Contest. Sponsors reserve the right, in their sole discretion, to disqualify all such contestants from future contests conducted by the Sponsors without further notice.
3. An entrant who is the age of 13 or under must have the consent of his/her parent or legal guardian to submit his/her personal information in order to enter the contest. The parent or legal guardian must complete all of the required fields on the relevant portion of the Entry Form, including his/her name and e-mail address. If a parent or legal guardian does not provide consent, the entrant will be disqualified. All information obtained for this Contest will be used only for the purposes of conducting the Contest.
4. CONTEST CLOSING DATE: The Contest closes at 9:59 AM ET on Monday, April 5th, 2010 (the "Contest Closing Date").
SECTION 2: PRIZES
1. There is One (1) Grand Prize Package available to be won, consisting of:
• One (1) Fisher-Price® Thomas & Friends™ Take-n-Play™ Percy's Mail Delivery Portable Railway Set;
• One (1) Fisher-Price® Thomas & Friends™ Take-n-Play™ Thomas at the Farm Portable Railway Set;
• One (1) Fisher-Price® Thomas & Friends™ Take-n-Play™ Cranky at the Docks Portable Railway Set; and
• One (1) Fisher-Price® Thomas & Friends™ Take-n-Play™ Tidmouth Sheds Portable Railway Set.
Approximate Retail Value of the Grand Prize Package is $135 CAD.
2. There are Ten (10) Secondary Prizes available to be won, each consisting of:
• One (1) Thomas & Friends™ Take-n-Play™ Cranky at the Docks Portable Railway Set
Approximate Retail Value of each Secondary Prize is $39.99 CAD
3. All Prizes must be accepted as awarded and are not transferable or convertible to cash. No substitutions except at Sponsors' option. Sponsors reserve the right to substitute a prize or a prize component with one of equal or greater value. Limit of one (1) Prize per person/email address. Prizes will only be awarded to the entrant whose full name and valid email address appears on the Entry Form.
4. The approximate retail value of each Prize is that stated by the supplier as being in effect Thirty (30) days prior to the launching of this Contest.
5. NOTE: All required documentation for redemption of the above Prize will be sent via mail directly to the selected entrant's home. Only after the selected entrant has met the eligibility requirements outlined in these Official Contest Rules and Regulations, and the selected entrant (and his/her parent/legal guardian if he/she is a minor in his/her jurisdiction of residence) has completed, signed and returned the Official Contest Declaration and Release Forms ("Release Forms") to the Sponsors, will the selected entrant be confirmed as, and declared a winner.
6. Each selected entrant (and his/her parent/legal guardian if he/she is a minor in his/her jurisdiction of residence) will be required to complete, sign and return a Declaration and Release' form in which they assume all risks associated with acceptance and use/misuse of the Prize. These forms must be returned, properly executed, within ten (10) days of notification or the participant will thereby forfeit the Prize.
7. The Sponsors will not be held responsible for the loss of prizes due to changes in mailing addresses, errors in completed Entry Forms or any other circumstances leading to an invalid, erroneous or incomplete mailing address or e-mail address. Prize will be delivered within 30 days of receiving the Release Forms.
SECTION 2a: PRIZE DRAW
1. Independent Judging Organization - A random draw for all prizes from all eligible entries received by the Contest Closing Date will take place on April 7th, 2010 ("Draw Date") at approximately 2:00p.m. ET in Brantford, Ontario. Chances of winning are dependent upon the total number of eligible entries received. Each selected entrant (or his/her parent/legal guardian if he/she is under the age of 13) will be notified by mail. If, within seven (7) days of the Draw Date a selected entrant (or his/her parent/legal guardian if he/she is under the age of 13) cannot be contacted, or fails to respond to any attempted contact, such selected entrant will be disqualified, his/her entry will be declared null and void and the Sponsors reserve the right, in their sole and absolute discretion, to select at random another eligible entry, in which event the foregoing provisions of this sentence shall apply to such other eligible entry.
2. In order to win a Prize, each selected entrant will be required to correctly answer a mathematical skill testing question without assistance or mechanical or electronic aid, and sign (and have his/her parent/legal guardian sign if he/she is a minor in his/her jurisdiction of residence) the Release Forms confirming compliance with the Contest rules and releasing the Sponsors from all liability and acceptance of the Prize as awarded. The Prize will be delivered only to the confirmed winner (or his/her parent/legal guardian, if applicable). If the selected entrant (and his/her parent/legal guardian if he/she is a minor in his/her jurisdiction of residence) fails to sign and return the Release Forms within ten (10) days of the selection of his/her entry, or within such later period of time, if any, as may be permitted by the Sponsors, in their sole and absolute discretion, will be disqualified, his/her entry will be declared null and void and the Sponsors reserve the right to select at random another eligible entry, in which event, the foregoing provisions of this sentence shall also apply to such other eligible entry.
3. If a selected entrant is under the age of majority in his/her jurisdiction of residence, then his/her parent or legal guardian must sign the Release Forms documents and accept the Prize on the selected entrant's behalf.
SECTION 3: ELIGIBILITY
1. The Contest is open to individual residents of Canada (excluding residents of Quebec under the age of 13).
2. This Contest is not open to employees, representatives, and agents (and those with whom such persons are domiciled) of the Sponsors, their respective parent, related and affiliated companies, advertising and promotional agencies. By entering the Contest, each entrant (and his/her parent/legal guardian if he/she is a minor in his/her jurisdiction of residence) agrees to abide by the Contest rules and all decisions of the judges, which shall be final and binding on all entrants in all matters relating to this Contest. This Contest is subject to all applicable federal, provincial, and municipal laws and regulations. Void where prohibited by law. Corus Entertainment Inc. ("Corus"), with the consent of the Régie des alcools, des courses et des jeux (the "Régie"), reserves the right to cancel or suspend this contest in the event of any accident, administrative or other error of any kind.
3. In order to be eligible to win a Prize, entrants must comply with these Contest Rules.
SECTION 4: CONSENT TO USE OF PERSONAL INFORMATION
1. By entering this Contest electronically and voluntarily providing your personal information (including, but not limited to email address, first name, last name, mobile phone number, city, province/territory, postal code, and home phone number) (collectively "Registrant Information") you (and your parent/legal guardian if you under the age of 13) consent and agree to the Sponsors' collection and use of the Registrant Information to administer this Contest. Any questions regarding the Sponsors' privacy policies and/or treatment of an entrant's personal information should be directed to G. Remy, Privacy Manager, Corus Entertainment, either by email at privacy@corusent.com or by regular mail at Corus Entertainment, Inc., 64 Jefferson Avenue, Unit 18, Toronto, ON, M6K 3H4.
2. By entering the Contest, each entrant (and his/her parent/legal guardian if he/she is a minor in his/her jurisdiction of residence) consents to the use of his/her name, province/territory of residence, image on videotape and/or photograph, without further notice or compensation, in any promotion/publicity and programming purposes, commercial or otherwise, in all media used by the Sponsors, and their respective advertising and promotional agencies, without payment or compensation. Sponsors make no representation or warranty that any identification, videotape, photograph and/or likeness of any winners will be broadcast or used otherwise in any manner.
SECTION 5: GENERAL CONDITIONS
1. By participating in this Contest, each entrant (and his/her parent/legal guardian if he/she is a minor in his/her jurisdiction of residence) acknowledges compliance with, and agrees to be bound by, these Contest Rules and Regulations, including eligibility requirements. Further, each entrant (and his/her parent/legal guardian if he/she is a minor in his/her jurisdiction of residence) agrees to release and hold harmless the Sponsors, their respective parent, related and affiliated companies, subsidiaries, members, dealers, advertising, franchisees, promotional agencies and each of their respective directors, successors, sponsors, partners, licensees, officers, subsidiaries, agents, employees, advisors, assignees, and all others associated with the development and execution of the Contest, from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims and demands, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach and liability for physical injury, death, or property damage which the entrants or his/her administrators, heirs, successors or assigns might have or could have, by reason of or arising out of the entrant's participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of the Prize awarded. All Contest entries become the property of Corus and no correspondence will be entered into except with selected entrants. The Sponsors, with the consent of the Régie, reserve the right to cancel or suspend this Contest, or to amend these Contest Rules without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind.
2. The Sponsors are not responsible for incorrect or inaccurate entry of registration or entry information which may affect an entrant's inability to get through on the internet during the promotion or ability to participate in the Contest, including but not limited to human error, technical malfunctions, lost/delayed/corrupted data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, any inability to access the site, or damage to a user's system occasioned by participating in the Contest, and entries which fail to fully comply with these Contest Rules and Regulations. The Sponsors reserve the right, subject only to the jurisdiction of the Regie in Quebec, to cancel or suspend this Contest without notice should a virus, bug or any other cause beyond the reasonable control of the Sponsors corrupt the security or proper administration of the Contest. Sponsors further reserve the right to suspend, modify or terminate this Contest at any time, for any reason, without any prior notice. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law. Entries are subject to verification by the judges and will be declared invalid if they are forged, falsified, altered or tampered with in any way. In the event of a dispute regarding who submitted an entry, online entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. A selected entrant and/or his/her parent/legal guardian of a selected entrant may be required to provide proof that the selected entrant is the authorized account holder of the email address associated with the selected entry. The sole determinant of the time for the purposes of a valid entry in this Contest will be the Contest server machine(s).
3. For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
